In theory, the European Union should have a “Common European Asylum System” in place – one of the most sophisticated regional systems for the protection of refugees and other persons seeking international protection. However, the gap between theory and reality seems to widen every day as evidenced by acrimonious confrontations between member states, stranded refugees, and very little in the way of common standards or solidarity among neighbors. In this lecture, I will briefly recall the international law foundations on which any European system must be built. Secondly, I will review the basic principles and structure of the Common European Asylum System and the Schengen common travel area as currently foreseen by EU primary and secondary legislation. Third, I will offer my reading of why the arrival of 1 million persons, roughly the number of refugees hosted by Lebanon alone, and about half the number of those hosted by Turkey, has so destabilized the Common European Asylum System. This will be the springboard for a discussion of what the EU could do in order to solve the current crisis and place the Common asylum system and Schengen travel area on new and more sustainable bases.
